Shot 1 Black Screen

Title 1 LONDON 15

Title In the glory days of the Elizabethan theatre, two playhouses were fighting it out for writers and audiences.

Buy cheap Shot Analysis of First five shots of "Shakespeare In Love" term paper

Low angle, long shot of blue sky, some clouds visible craning down and panning rightwards.

Title North of the city was the Curtain theatre home to Englands most famous actor, Richard Burbidge.

Camera continues craning down and panning right, we see the roof and then interior of a theatre. As the building comes into shot, the length of shot is now medium, but does not change for the rest of shot (no zooming, or tracking in)

Title 4 Across the river was the competition, built by Philip Henslowe, a businessman with a cash flow problem.

Title 5 ...the rose

The titles appear over the top of shot as the camera continues craning down and panning right. There is no particular focus on the foreground or middleground allowing us to see the whole interior of the theatre in focus. Clothes are draped over the rafters and blowing in the wind. Leaves float upwards. We see the stage with various props come in to view and a coat blows in the wind as the camera passes. doorways at the back of stage suggest offscreen areas yet to be revelaed. Stairs lead off at the right where the camera pans to a manuscript not yet readable lying on the dirt floor. The camera idles for a moment with a down view of the manuscript which moves in the wind as the shot dissolves.

Shot one establishes an inferred role of this stage in the narrative.

Lighting Soft natural environmental light (from the sun as the building has an open design). The earthy browns and grey tonality of the building and ground give a nostalgic feel for sixteenth century England.

Dialogue None

Sound Shot opens with the sounds of wind, church bells and the chatter of people. The dialogue is diagetic but offscreen. Shot ends with a siren sound and the crinkling of the manuscript blowing in the wind.

Music Shot starts with soft flute/oboe and then slightly intensifies as the camera pans through the theatre. The style is classical and is non-diagetic. The melody has an airy feel which seems to follow the camera movement well.

SPFX Possibly a fan offstage to create the wind effects.

Duration 116

Transition Dissolve. Siren sound is also used to transition between shots.

Shot Camera is on a vertical axis and zooms in to a close up shot of the manuscript lying on the ground. the lamentable tragedie of the moneylender revengd.

Lighting Top soft lighting.

Dialogue Henslowe! Do you know what happens to a man who doesnt pay his debts. Screaming heard. The dialogue is diagetic and offstage.

Sound none (besides dialogue and music)

Music As per shot 1, but fades out as the dialogue starts.

SPFX none

Duration 006

Transition Dissolve.

Shot Fast tracking in through the doorway at the back of the stage, to a low angle medium close up of a man tied up and seated, whose boots are being hung over hot coals. This is presumed to be Philip Henslowe. The camera angle is on axis with Henslowes legs. His boots are slightly more in focus than the rest of him, and the background is out of focus.

Lighting Ground earthy grey/brown colour gives extra dimension to the squalored scene in the shot. The colour does not appear to be stylised however. The coals are bright orange and draw the viewers focus. Henslowes face is quite orange in hue (his boots are on fire after all). Shadows and light trails (exaggerated by the smoke) can be seen in the background but is out of focus. Shadows on underside of Henslowes boots and chin suggest top lighting is used, with some sidelighting to stimulate natural light coming through the windows.

Dialogue His boots catch fire. Heard offstage but presumed to be in the room. Henslowes Screams are now heard onstage. Both are diagetic.

Sound Crackling smoldering sound of boots burning. Diagetic and onscreen.

Music Fades back in as the camera tracks in through the doorway. The mood is now much more tense which gives a hint of the scene to come. The style is classical.

SPFX Smoke and fire effect.

Duration 006

Transition Cut

Shot 4 Cut to a medium shot from behind a dark rafter of two men. The camera tracks left around on a circular axis. The man on the left (Mr Fennyman), walks toward the right and is delivering a dialogue. A second man in the middle of screen holds a rope (Mr Lambert), who as the camera tracks left we can see is holding Philip Henslowes legs (who is now centre of shot) above the coals. The camera continues tracking on the circular axis to reveal a third man on the right almost offscreen (Mr Friez). The camera continues behind another dark rafter and then stops to show all characters onscreen. Philip Henslowe is central to the shot with the other protagonists close around him. Mr Lambert to the left holding the rope, Mr Friez standing to the right, and Mr Fennyman paces left. As the camera tracks around, then coming to a stop, the angle of shot is slighty angled high looking down on the 4 characters on screen.

Lighting The characters are quite darkly dressed and so appear dark in the room. The room itself is however quite well lit with sidelighting (as per shot ). The centre of shot is more illuminated than the rest (Suggests top lighting or possible spot lighting). The faces of the characters are well lit but attached shading is visible. The lighting is diffuse. The mens faces have an orange hue, to simulate the heat of the room. Some casting shadows are seen from the men and objects in the room. Fennyman also casts a shadow on Henslowe as he passes him.

Dialogue Fennyman, Why do you howl. Delivered offscreen (still diagetic) as the camera tracks in to the room. Fennyman, When it is I who am bitten? onscreen and diagetic. Screaming is still heard, partially offscreen when Henslowe is out of shot. Fennyman paces left, What am I Mr Lambert?. Lambert replies, Bitten , Mr Fennyman. How badly bitten, Mr Friez?. Friez replies, 1 pounds, 1 shilling, and four pence, Mr Fennyman including interest. Henslowe lets out a little cry. Henslowe begs, I can pay you. Fennyman, When, as the shot cuts. The dialogue is onscreen and diagetic.

Sound As per shot , with additional sound of rope as Henslowes legs get raised and lowered above the coals. The sound is onscreen and diagetic.

Music As per shot . Fades out as the camera tracks in and the dialogue takes over.

Duration 01

Transition Cut. Dialogue continues through the cut to the next scene (as Fennyman says when).

Shot 5 Cut to medium close up of Henslowe. Camera is stationary in this shot, the angle is on axis with Henslowes legs and the focus is on his face. The foreground (Henslowes boots) is out of focus as is the background.

Lighting Top lighting, face well lit with harder lighting than previous shots, creating gleams on Henslowes sweaty face which is now positively glowing orange/red. More attached shading visible on Henslowes face and hands. Background as per shot .

Dialogue Henslowe, weeks, weeks at the most, ugh. Onscreen and diagetic.

Sound as per shot 4

Music none

SPFX Smoke in the room, the coals are not visible in this shot.

Duration 00

Transition Cut.

"Nothing endures but change" as Heraclitus once said. It seems to be the only thing that is constant in our lives and is invariably difficult to deal with. Gwen Harwood's poems reflect her ideas concerning change that often leads to greater perception on the part of an individual, which in turn leads an improved management of change. Three such poems are "In the park", "Father and Child" and "Prize giving". Notions of change are also evident in the Biblical reference of Adam and the fall, and the Film "My fair lady" directed by George Cukor. Change is also represented through text five of the stimulus booklet, which is a print screen visual from an interactive encyclopaedia program defining Fractals. These composers of text represent change by showing its effects on people through the passing of time and pivotal events, which occur in our lives.

Change is apparent in the sonnet "In the park" by Gwen Harwood, as we encounter a young woman with several squabbling children sitting in the park. The fact that her "clothes are out of date" and she has Two children [that] whine, bicker [and] tug her skirt" somewhat acquaint us to the stereotypical traumatic single mother, whose good fortune has long expired. This Notion gains addition through the line "Some one she loved-once passes by too late". The middle paragraph uses clichs such as "how nice" and "time holds great surprises" to show the superficial relationship that the persona holds with her former lover and uses contrasting imagery such as "His neat head", against the perceived ragged mother. The undesirable image of the woman is confirmed through his thoughts "but for the grace of God" and Ironic tone is later used "It's so sweet to hear their chatter". Clearly, his perception of the woman has changed over time, particularly in regard to her children. She now has no-one to share her sympathies with except for "the wind", to whom she says "they have eaten me alive" in a metaphorical tone. This event also imposes a profound change in the mind-set of the woman - the outlook of regret.

The change in self-perspective from contentment to regret is evident also, in the biblical text of Adam and the Garden of Eden. In the book of Genesis we are told that after they ate the forbidden fruit, God approached Adam who replied "I heard thy voice in the garden, and I was afraid, because I was naked; and I hid myself." This symbolizes Adam's shame and regret. Regret is also portrayed later, when Adam receives punishment for his disobedience. Another evident change, which takes place in this text, is the loss of innocence. The connotation of perfection is denoted through repetition of the phrase "God saw that it was good". But ensuing Adam's insubordination, "God sent him forth from the garden of Eden, to till the ground from whence he was taken". This is often referred to as the "fall" as it indicates a change in nature and a loss of innocence.

Similarly the first canto from Gwen Harwood's poem Father and Child also indicates a change in nature and a fall from grace. The juxtaposition of biblical allusions such as "horny fiend" and "angel mild" helps symbolize loss of innocence of the child. Stark and contrasting imagery such as "A lonely child who believed death clean and final, not this obscene bundle of stuff that dropped and dribbled" helps represent the contrast between innocence and condemnation. A remorseful change occurs "I leaned my head upon my father's arm, and wept" which is indicative of a change in heart, and gained experience. With the assistance of hindsight, the second canto continues on forty years with a reflective tone. The father and child reminisce about the past and the changes that have occurred. "The child once quick to mischief, grown to learn what sorrows, in the end, no words, no tears can mend".

Similarly the stimulus text 5 Fractals, symbolizes how change in time has caused a change in context, particularly in the world of knowledge. Fractals are a new field of mathematical discovery, which reflect change as they are multifarious and demonstrate infinite complexity as does change. Paradoxically they give us a sense of consistency in a changing world, which is reflective of the principle human self-nature, which has remained constant. The text is of a multimedia format, which represents progression in the communication industry and is indicative of how fast our world is undergoing technological transformation. Clear Layouts, bright colours, fonts and graphics capture the audiences' attention and utilize sight, sound and computer technology. The use of such technology was unknown mere decades ago, which clearly represents the change in the new generations' sense identity.

A comparable change in one's sense of identity is portrayed through Gwen Harwood's poem Prize-Giving. In this enjambment, an arrogant professor attends a girls school speech night as an honored guest, only to have his sense of identity challenged by his desire for a cheeky young schoolgirl. Contrast such as "superb in silk and fur with pride" juxtaposed against "humbler black" and emotive language such as "to grace their humble platform" and "tortured to form the schools elaborate crest" are used to portray the professor as aristocratic. The use of similes including "Rodin's Thinker" which symbolizes intelligence and honor also enhances this perspective. Through these techniques, the omniscient narrator contrasts the professor against a sassy young girl, whose "hand bent under her chin in mockery of his own". When she collected her prize and shook his hand, he " felt its voltage fling his hold from his calm age and power". He is a "sage fool trapped" by this voltage of desire, which undermines his own sense of identity. It is evident that inward change has occurred as this apparently refined professor "teased his gown while others clapped". Finally as he peers into a trophy, his image is suspended upside down which is metaphoric of his world being turned upside down.

In the movie My fair Lady, directed by George Cukor, Eliza's world is turned upside down, as her sense of identity changes. Eliza is part of an inferior class of society who is strictly limited by her inadequate street slang. "Look at her, a prisoner of the gutters Condemned by every syllable she utters" sings Henry Higgins, a professor of speech. Song is used here to lock a feeble impression of Eliza inside the audiences mind. The use of emotive language aided by the visual component of video helps to portray the character of Eliza. Due to his friend, Colonel Pickering and his challenge to transform this "draggle-tailed guttersnipe" into a duchess, the professor vows, "Ill make a queen of that barbarous wretch. Predictably, the professor takes Eliza in and teaches her superior English and etiquette, and they begin to fall in love and Eliza's life becomes transformed. But the professor believes that if you "let a woman in your life and your serenity is through" and treats her with much contempt. As her speech matures, so does her character and she realizes that she has been well bred for appearing in high society, but is not assured of her place in that world, yet she has also become distant from her world among the gutter-dwellers. When asked why she is upset, she replies, "The difference between a lady and a flower girl is not how she behaves, but how she is treated. Change is evident not only in the transformation of Eliza's character, but the development of her maturity. This causes remorse in the professor and a change in heart towards her.

As Leo Tolstoy said "Everyone thinks of changing the world, but no one thinks of changing himself. Changes such as regret, loss of innocence, changes in maturity, identity and character all reflect a change in self, as they are all external manifestations of an internal change.

Task. Business Activities

Now that both each of the businesses ownerships have been identified and the industrial and business sectors have been explained, it is time to move on to explain how each of the businesses have main activities, how they are carried out and how the two businesses operate.

Pegasus Cycles

The aims and objectives of the private limited company Pegasus Cycles is too produce high quality bicycles. This means making bicycles that suit the needs of the customers, only top quality materials should be used to maintain there high quality standards. As well as keeping there, high quality standards, Pegasus Cycles needs to keep pushing there designs so that the public will want to buy Pegasus products.

The way in which Pegasus makes there bicycles is as follows a bicycle frame is made from different tubes, these tubes are then welded together to form the frame structure. The bicycle frames are made from one of four different materials.

Aluminium - this material is used because it is lightweight, the downside to this particular material is that it is quite brittle. This can be overcome by making the tubes larger and making sure the welding is thicker, this lessens the chance of the frame breaking.

Steel many of the bicycle frames are made from this, which is because steel makes the bicycle highly resistant in a crash and it is the cheapest of the materials on offer for making bicycle frame.

The best of the materials is Titanium, but as well as being the best, it is also the most expensive. Titanium is lightweight but strong, this makes it the perfect choice for a good bicycle. Another material that is like Titanium that is used, is Carbon Fibre. These two materials are very expensive and the retail price for them will be quite high, only the more wealthy customers or professional racers will be buying these expensive type frames.

When the bicycle frame has been made to the desired design, the next step would be to find a good set of wheels, a seat and a seat post, some handlebars and stem, the cranks and pedals, the brakes and the chain and gears. Pegasus has to make sure that the bikes are made for a specific group. So general bikes will be made from steel and have the basic 10-speed gears where a modern mountain bike would be made from titanium and have as many gears as 4.

All of the bikes have to be up to the standard, if the customers are not happy with a product brought then they will look elsewhere in future.

Before the construction of each of the bikes that are to be made, a careful examination of each of the tubes has to be made. Any of the tubes that falls under the expected standard is taken and sent back to the supplier, but Pegasus select there suppliers carefully, so that all materials brought are of excellent quality. After being checked thoroughly the tubes are then welded together by a team of skilled craftsmen. After this, the frame is checked to make sure the alignment is perfect and the craftsmen ship is up to scratch. The frame is now put through a process called 'heat treating' and then coated so that it is resistant to all types of weather, each of the frames are painted using a electrostatic powder process. When the frame is totally finished and perfect, the wheels and all other components such as the breaks and gears are fitted and aligned by hand.

After the bicycle is made, everything is working fine and everything is up to the high quality standard the bicycle will then be ready to sell.

Pegasus Cycles started making bicycles that were cheap and easy to manufacture, over the years Pegasus Cycles has moved on, it is now making advanced structured bicycles.

Phil Spence considers the 'mass market' out of reach. Therefore, he finds that expanding the company over seas would not really benefit them much. There are many competitors over seas and in the UK he would have to compete with and with the cost of shipping bikes over, profit wouldn't be made and it could become to much and the company would start losing money. Regionally is the way best suited to Pegasus Cycles. Although Phil Spence does think that, it could be worth selling small components and spare parts over the internet. This would be the only way of selling nationally that he would be interested.

The trends in Pegasus Cycles are that staff are slowly leaving the workforce and either moving on to higher education, better jobs or moving into the ever-expanding Tertiary sector. You can see on the table in Task. the fall of primary and secondary employment and the massive expansion of the Tertiary sector.

People need specifically designed bicycles; Pegasus Cycles meets the needs of the public. People always want better products, everything needs to be upgrade and within fashion, it is Pegasus job to comply with the publics, general needs.

Tom Greenways

Greenways Estate Agents main aims and objectives is to provide top quality houses to the community, especially the students that study within the surrounding area. The estate agents need to make sure they have enough knowledge to sell houses effectively.

The quality of the houses Greenways has to offer the public, need to be of high quality, this is because they want the best possible public interest. The business would not survive offering houses that nobody wanted. If the houses are not of a good quality then customers will go elsewhere to buy a house.

Hell in a Hand Basket

Everybody has heard it before, but few know what it means. "Those were the

good ol' days." An ancient saying passed down from generations to describe "the world as it used to be." It is hard to believe that there was a time in history when people could leave their doors unlocked without fearing a robber. Or a time when drugs were used distinctly for curing illnesses. Let's face it, the word as we know it is nothing like this image. It is distorted in all possible ways. As human beings, we are naturally curious. We never stop wondering about things. This is something that has always been, but has evolved tremendously since "the good ol' days." What we fail to realize, though, is that our curiosity leads us in the wrong directions. A boy experimenting sexually with his teenage girlfriend, a high-school dropout trying drugs for the first time these are examples of the curiosity that has led this world to "hell in a hand basket." If this is evident, why does nobody attempt to fix it? Nobody wants to. It gives us the entertainment we constantly desire. The entertainment and horror experienced in "Videotape" is because of this and only this. With his puzzling metaphors and movie-like action, Don DeLillo shows us how our world has changed.

The unexpected always attracts the audience. The same thing happens every time; we "expect the unexpected." Movie-goers always seem to foreshadow what will soon happen. As the theatre darkens and resorts to silence, we all wait for the moment when the speakers blast and we all lose our popcorn. Movie directors know exactly what makes us tick. DeLillo seems to know quite a bit about this approach, also. During the course of the essay, DeLillo describes the characters in detail, but does not describe the setting in much detail at all. He leads us to believe that this trip is long, quiet, and on an empty highway somewhere in Texas. He even goes on to describe the child taping the man in the following car for a long time with nothing happening. Just as movie directors scare us in the "moment of silence," DiLillo does the same with the murder of the victim. Because the murder happens fast, and is from an unseen car, the girl has no time to react and is in shock until an unknown time. This is often seen after horror movies when people cannot "believe their eyes." If these films startle us so much, why do we always come back for more? They move us in a way that no other thing can. People abuse drugs to experience euphoria, have sex for shear pleasure, and see movies to get laughs, tears, spooks, and fears. As curious individuals, we want to experience everything this world has to offer, without really experiencing it. We want the general feel of it, but without the consequences.

Cheap Custom Essays on Hell In A Hand Basket

In DeLillo's essay, he clearly lets us experience a murder, without even being there. And old saying says, "A picture is worth a thousand words." If this is the case, a video is worth millions. One distinct feature that DeLillo incorporates in this piece is the sense that the essay itself unravels like a film. He begins by describing the main "characters" in the story, but only just enough. He wants you to get to know them, almost personally, but doesn't reveal things such as their names. DeLillo describes the events in this essay much like a script-writer writes a script for an actor. Not only does he tell "what" happens, but also "how" and "when" it happens. He goes in great detail about describing emotions, also. As the essay progresses, the video is said to be in black and white. What does this say about the film? It foreshadows that the obvious death will not be gory, but "clean." This says something about the horror movies we live for in our day of age.

Modern-age horror films are usually bloody and gruesome, to say the least. Films such as Scream, Nightmare on Elm Street, and Friday the Thirteenth give us a very good visual sampling of this. Although these are very popular and adored by many, they are not what they were in "the good ol' days." Take The Creature from the Black Lagoon for example. This film was immensely popular and still remains a favorite among many. The strange thing is, there is absolutely no blood in the film and it is in black and white. So why was it so popular? Films back then did not need blood and gore to make them a success. The shear suspense gave audiences exactly what they were hoping for. This is what DeLillo does with his "film." He makes it in black and white to show that it will focus more on the suspense and less on shear horror. As color video cameras were developed through technological advances, we found a way to become more descriptive in the way we portray things on film. Blood could finally be "red." So why do we feel the "need" to see these disgusting sights?

We thirst to see these graphic images because they are out of the norm. Every day, in every place, we see people greet each other, interact with each, and care for each other. This has been a normal sight for humans from birth to death. One thing most of us never personally see is a murder or death. We ask ourselves what it looks like to be killed. No matter how sick and cruel it sounds, everybody is guilty of it. There is a series published on VHS and DVD called "Faces of Death." It portrays "real" people being killed in "real" ways. This isn't like the fake horror movies you rent at Blockbuster. It shows every kind of death, from getting eaten by an alligator to being electrocuted on the "chair." Because of every curious boy and girl out there, we now are so used to seeing death and violence, that it isn't any different than seeing a car go by, or a women jogging down the street. It has almost become a social norm, in other words. This weird obsession with viewing death is portrayed in the essay when the man calls his wife over to the television set to watch the footage. He even gets aggressive and makes sure that she watches it, as if she herself will die if she does not. Although death has become "no big deal" to us living in this decade, it only seems to be that way when it's not personal. Strangers being murdered is no big deal, our attitude always seems to tell us. But when family and close friends are the victims, we realize just how serious and devastating it is. Our attitudes can completely change in a matter of seconds. When the victim of the gun shot waved at the little girl a few times, it seems to strengthen the relationship between the two, even though they had never met. This probably explains why the little girl was in so much shock. This was a nice man who appeared to have his "whole life open" and he was shot for no apparent reason. Not only was the man killed physically, the little girl was scarred emotionally. Memories of death never go away, no matter how hard we try.

With his puzzling metaphors and movie-like action, Don DeLillo shows us how our world has changed. As the generations shift, so do the people living in them. We often adapt to how our peers and the media tell us to act. Discovered by Sociologists, this is called "conforming" to the situation. If homosexuality becomes more acceptable, we stop the discrimination; if violence happens on a daily basis, it also becomes more acceptable. Whereas bellbottoms and platform shoes remind us of our parents' generation, violence reminds us of ours. Our world, indeed, has gone to "hell in a hand basket." Violence has spread like wildfire, with considerable evidence to prove it. DeLillo lets the experience of "our" generation be felt by all. He puts us in that little girl's shoes and gives us no sympathy for the horror we "see." He lets us know that "anything" can happen to "anybody" at "any time." This is real life, and no essay shows it more.

Employee Complaints

Abstract

Help with essay on Title VII-Employee Complaint

Based upon the Civil Rights Act of 164 (Title VII), you may file a charge of discrimination with the U.S. Equal Employment Opportunity Commission (EEOC) if you feel you have been negatively discriminated against by your employer because of your gender, religion, age, disability, or race. There are timeframes in which you may file this claim.

We will serve as managers of ZYX Corporations Human Resource Department, which has received a complaint from an employee regarding, what he feels is a discriminatory based test, which is keeping qualified African American applicants, such as himself, from being promoted into the managerial level. Also addressed in this complaint are equal rights for males and females of the company regarding dress code, as well as personal grooming choices.

This paper will discuss, based upon this scenario, possible outcomes of these complaints, as well as the process for filing a claim with the EEOC, for both employer and employee.

Introduction

We have received a formal complaint from John Doe, one of this company's employees. "In this compliant, Mr. Doe claims that the company test he was recently given, to determine if an employee is qualified for promotion into management, is discriminatory." He claims it has a negative impact on African Americans. In addition, Mr. Doe feels it is discriminatory that while women are allowed to wear earrings, males are not, as well as the how the company code addresses the length of men's hair, but does not give equal assessment to the length of women's hair.

We will address this complaint by going over company policy, as well as addressing this situation with the company's legal staff, as, if the outcome of our decision is not favorable to Mr. John Doe, he may then seek to file a claim with the EEOC, under the claim of either Disparative Impact, Disparative Treatment, or Intentional Discrimination Against a Class. Under any one of these grounds, he may file a claim under Title VII.

Questions/Body

If an employee feels that he/she is a victim of discrimination where they work, they have the right to file a claim with the EEOC. Filing a claim is free for the employee. However, they do have to go to the local EEOC office and file a claim. The local office has an obligation to investigate the claim filed regardless of what it is. For government employees, a claim must be filed within 0 days of the alleged act of discrimination. For private sector employees, a claim must be filed within 180 days. This is to keep the incident fresh in the minds of potential witnesses and also to help make sure that those witnesses are still in the area.

Some states have their own enforcement offices of EEOC regulations. If this is the case and the state has contracted through the EEOC, it is known as a 706 agency. Claims that are made to the EEOC will be deferred to the 706 agency. Should the 706 agency not be able t get an agreement between the employer and the employee, the EEOC does an investigation. The EEOC has to notify the employer with-in 10 days that a claim has been filed against them. Potential interviewees will be made available for the purpose of the investigation. Investigators will interview personnel, review records, and attempt to find reasonable cause for the complaint.

The EEOC (or 706 agency) will set up a mediation process for the employee and employer in an attempt to settle the complaint prior to a full-scale investigation. This mediation process was started in February 1. It is voluntary for both parties and if they agree to mediation, it must be completed within 60 days if it takes place in-house, or 45 days if it takes place outside the workspace.

When both sides agree to the findings from the mediation process, then the claim ends. If one side or the other doesn't agree with the findings, then the process goes back to the EEOC for further investigation. After the investigation, if the EEOC finds that there isn't a cause (called no cause), then the employee is notified by the EEOC via a 'right to sue' letter. If the EEOC finds that there is reasonable cause, then they notify the employer of possible remedies to the claim. The employer then chooses to either accept the remedies or challenge the findings through an appeal process.

The employee will have to prove that he/she was discriminated against under the federal laws that fall under the realm of EEOC regulations.

Upon review of the management entrance examination with our legal staff, we uphold the validity of the exam. We, the company, do not feel it is discriminatory against African Americans. Reviewing the ratio of African American employees in the entry-level positions against the ratio of African American employees in the management level, there is reasonable consistency to back up the exams validity. There is currently a case of race discrimination,

similar to this complaint, which is awaiting appeal in the Supreme Court. Adams vs. City of Chicago, 4CV 577, which involves the 14 sergeants promotional test prepared for the Chicago Police Department. The plaintiffs were African-American and Hispanic Chicago

police officers who contend that the test has a disparate impact and is unlawful employment practice. They contend that proportionally fewer minorities were offered promotions, constitution discrimination. Again, our numbers show that the ratio is equal between the number of minority entry-level employees vs. minority management.

The second part of Mr. John Doe's complaint, which addresses the dress/grooming code, has also been upheld as valid by our legal staff. When Mr. Doe signed the contract to become a Full Time Employee with the company, he agreed to abide by our policies, which included the policy regarding earrings for men and hair length. Being a continually growing and prospering company, this is something that can be looked at in the future, to maintain if this is an outdated policy that may need reviewing. For now, however, we stand by the policy to which Mr. Doe was aware of before he accepted his position with the company.

Conclusion/Summary

The specific process for filing a claim with the EEOC is spelled out very clearly. An employee can file a claim without cost to them, which is very good because not all employees can afford assistance in dealing with such claims. Both the employee and the employer have choices along the way once a claim has been filed. They may take the claim to a full-blown investigation and then have the EEOC hand down their opinion. They also have the choice to go to mediation before the full-blown investigation. The ZYX Company had a claim filed with the EEOC against them by an employee John Doe. Mr. Doe's complaint stated that ZYX was unfair and discriminated against him because he was African American and a man.Company officials along with the company's legal representative looked into the claims brought forth by Mr. Doe. The company found that it believes the company is in the right. There are a proportionate number of African Americans in entry-level positions that resonates with the number in a management level. It was also found that Mr. Doe signed and did not complain about the dress code/hygiene policy when he signed on as a full time employee. ZYX has done an internal investigation and stands behind the decisions they have made in the past.

Prejudice is defined as hatred or unfair treatment of a particular group, such as members of a race or religion or nation , the dislike or distruct of a person, group, custom etc that is based on fear or false information or to make any judgment without having adequate informations. Prejudice can be defined as dictionstereotyping, racism and segregationary as hatred or unfair treatment of a specific group because of preconceived attitudes or opinions about other people. Prejudice is a preformed and unsubstantiated judgment or opinion about an individual or a group, eitherfavorable or unfavorable in nature. However, the term usually denotes to negative attitudes held toward others based solely on their membership in a specific group(social or ethnic).

The source of prejudice is ignorance or a persons unwillingness to understand others. This leads to discrimination and hatred. View or opinion that ones own group is the center of civilization; all other groups are merely a reflection of ones own group, and ones own way of life is the best way of life. These group can be defined by economics, race, religion, caste, or class; some degree of ethnocentrism is known in all societies and cultures; racism and extreme nationalism are also examples of prejudice.

Dehumanizing nature of racial prejudice is one of the major form of prejudice based on perceived physical differences and usually refers to unfavorable or hostile attitudes toward people perceived to belong to another race. Racism usually results in a belief in the superiority of one's own race. The cause of racical prejudice is the human tendency to form stereotypes and generalized beliefs that associate whole groups of people with particular traits. Racial stereotypes are exaggerated or oversimplified characterizations of the appearance, personality, and behavior of a group of people. For example, at one time or another, certain racial groups have been described as lazy, stupid, athletic, dishonest, violent, or miserly.

Throughout the developing world, ethnic and racial minorities experience prejudice from majority groups and have difficulty attaining an average standard of living. For example, under the system of apartheid, enforced in South Africa from 148 to 1, the government systematically denied rights, fair treatment, and educational and employment opportunities to nonwhites, leaving them in massive poverty. Migrants and refugees, who have left their native land and settled elsewhere, also experience high degrees of poverty. Migrants commonly lose the immediate economic support of their families and enter into societies in which they may have difficulty finding good work, especially if they do not speak the language

In Europe, throughout history, ties of minority peoples with their countries of ethnic origin have led to international disputes and wars, as in the case of the Sudetenland. In a heterogeneous society, cultural and class differences between diverse elements of the population can become more pronounced, causing inequalities through discrimination. So prejudice and racism refer to beliefs or attitudes about people, discrimination refers to actual behavior and action based on these attitudes. Another example, racial discrimination takes place when an African American couple is denied a bank loan for a house that a similarly qualified white couple would have received. In the United States prior to the 160s, a lack of federal laws permitted discrimination against black Americans in housing, employment, education, public accommodations, voting, and access to the judicial system. These forms of discrimination led to the civil rights movement in the United States, a movement by black Americans to achieve racial equality.

Relating to religion, prejudice is one of the most destructive animal held sacred, despair and terror completely overpowering reason. Religion is another name for fear in favour of those forms of worship which require the most bloody sacrifices considered most sacred to passion and imagination which are the most revolting to reason and common sense. the religious prejudices of Muslims and non-muslims roducing a mounting toll of bloody dead and injured and of property loss. The communal riots occurred in regions where the two great religious communities lived side by side ever in history. Religious intolrance an enlightened state in which the fires of greed, hatred, and ignorance have been quenched after the name of religion.

Minority Group, group of people sharing common ethnic, racial, or religious backgrounds, especially when constituting a comparatively small proportion of a given population. Minority groups often have fewer rights and less power than majority groups. Minority Group, group of people sharing common ethnic, racial, or religious backgrounds, especially when constituting a comparatively small proportion of a given population. Minority groups often have fewer rights and less power than majority groups.

What is the extent of this evil wickedness prejudice? How far will it go until the entire world realizes that it is wrong? Prejudice continues to infect and destroy the dreams and minds of many people. A human being is not born with prejudice. Prejudice is taught to children at an early age to make certain that their father's beliefs continue. By the time a child reaches adulthood, he or she might have the same hatred of their fathers. Prejudice has gone through many extremities promoting violance and anger towards the other who are different.

The weakness of spirits is one of the fundamental causes of prejudice, the person who has a strong spirit examines the facts before of extract the conclusions, thats so to say, judge after of knowing the thing, the weak person has a conclusion before of have exanmined the facts, thats to say, prejudice and fall in the prejudice. The biggest mistake that people commit is that they have not yet discovered the courage and meaning to act under their own ideas and thoughts and not for what the others do and say, and just for measure people for what they have and not for what they are, only, when they can realize this mistake only then we could achieve to finish with the prejudices that exist in the world.

There is no one reason for prejudice. Ignorance and hate contribute to that toxic thinking. Prejudiced behaviors in people is a response to a lifetime beliefs passed down generation to generation.

Presuming the genetic character of prejudice then thanks to selfishness, failure of moral imagination, hatred and ill-will. Infact human beings did not often have either an open mind or an open heart. This is not a hedrited trait but the only ignorance which is denial and promots prejudice as elitist.

The man is obviously an ignorant bigot. To defy prejudice let them know that you are learning and that you are trying to understand and to be whole hearted training their mind , charcter producing spirit of tolerance and art of co-existing. Enlightenment is man's leaving his self-caused immaturity. Immaturity is the incapacity to use ones intelligence without the guidance of another. Such immaturity is self-caused if it is not caused by lack of intelligence, but by lack of determination and courage to use ones intelligence without being guided by another.

Solutions include comparative knowledge of ones own and other cultures; concept does not involve only a preference for ones own way of life, but a prejudice against other ways of life. To eliminate the prejudice in society, people must be tolerant and examine their own beliefs and ways of thinking and operating in the world. They must look beyond their own histories and skin color and listen carefully to those who have been harmed. We as a society must learn from our mistakes. We require to make this world a better place. Our future and the future of those who follow us are counting on it.

Overcoming a Life of Violence

MY FRIEND and I ran as fast as we could, and when we reached the river near my hometown, we dove into it. As we surfaced, we began swimming furiously toward the opposite shore.

Was this some type of boyhood play? Not at all! It was more a matter of life and death. When I looked behind, I saw police with their weapons aimed at us. I dove underwater to escape the bullets and continued swimming to the opposite shore. Even underwater, I could hear the gunfire.

Once we reached the opposite shore, we had made good our escape from jail, where we had been locked up for burglary and car theft.

Cheap Custom Essays on OVERCOMING A LIFE OF VIOLENCE

This was one of many times I had been wanted or actually pursued by the police for some criminal action. Although I was only 17 years old at the time, I had already built up a long arrest record with the authorities. Eventually, my friend and I were caught, and once again I was sentenced to a prison term, this time for a period of two and a half years.

Even in prison I showed a violent disposition. Because of fighting with other inmates so often, I was given a white uniform. This made other troublemakers and me stand out for special attention by the guards.

More Violent After Release

I was released from prison, but I hadn't changed for the better. In fact, I was more violent than ever. I quickly established myself as a ruler of various streets. Anyone who would challenge me quickly found a willing combatant.

Once a group of young men irritated me. I attacked them, hurting several before police stopped the brawl, even though my right hand had been broken in a fight the week before.

Another time two friends and I challenged a group of men from a neighboring town. Their leader stepped out to meet me with an iron bar. I disarmed him, but he slipped out of my grasp and ran. The only way to get him to keep on fighting was to give him back his iron bar, which I did. He returned, and I disarmed him again, this time making sure that he didn't get away until I had given him a beating.

One night, just to have "fun," I stood on a street corner in Harlem, New York City, and challenged anyone to fight. Various ones took me up on the offer, and the battles were numerous. As a result, my reputation as a dangerous, violent person grew. In these various battles, I was hit with bottles, tire tools, and clubs and set upon with knives and other weapons. But all of this did nothing to turn me from my violent ways.

Violence Escalates

I soon discovered that there was much money to be made in the drug trade. Being a drug user, I was familiar with the drug society. Before long I had people selling drugs for me, making me even more violent.

Once we raided another drug dealer, hoping to steal his drugs. Armed with a pistol and a knife, we broke into his home and held three men and a woman hostage while we ransacked the house, looking for drugs.

Another time a friend and I, armed with shotguns and wearing ski masks, decided to rob a rich man so we could get money for drugs. We staked out his home, but he never appeared, so we left. Without a doubt, had he shown up, we would have carried out our intentions.

Thus, at just 0 years of age, I found myself deeply involved in violence, drugs, and serious crime. My future, at best, would be one of life in prisonand I was very unhappy.

I often wondered who should decide what is right and what is wrong. I concluded that it was whoever had the greater power in society. I also reasoned that since humans were deciding right and wrong, and I had absolutely no respect for any human authority, I had as much right as anyone to decide such a question for myself. But I was soon to find a far better answer.

A Far Better Way

My sister, who had married one of my friends I had been in prison with, had consented to a study of the Bible with Jehovah's Witnesses. She shared the things she was learning from the Bible with everyone in our familyexcept me. My family would tell me to avoid my sister. Why? They said that it was because all she talked about was that "crazy religion."

I was curious. What could she possibly say to upset people so much? I wanted to know, but my sister did not speak to me about it. Why not? She thought that I was too bad ever to listen to anything about the Bible.

But one evening I invited myself over to her home for dinner. I was sitting there eating with my sister and her husband, and I said "Tell me about this new religion." They didfor six hours! It made so much sense to me that I returned the very next evening to hear more.

After this second visit, I was convinced that I had found something to live for, a real purpose in life. Immediately, I began attending meetings at the Kingdom Hall of Jehovah's Witnesses and also speaking to my friends about what I was learning.

My life-style remained unchanged for a while. But I continued studying and learning about what Jehovah God expected, and I made sure that I didn't miss meetings at the Kingdom Hall, where the Bible was discussed. In this way I got the spiritual strength to change my life, one thing at a time.

First, I quit selling drugs. This angered some of those I had previously associated with, but I still had my violent reputation, which kept me out of harm's way. Next, I quit using hard drugs and also gave up my immoral life-style. The last thing I brought under control was my tobacco habit. In eight months I had progressed to the point of being qualified for baptism, and I was baptized in 170.

At last I had come to the full realization of the answer to my question about who is to decide what is right and what is wrong. The answer is Jehovah, our Life-Giver, has that right, and he also has the right to expect his creatures to live accordingly.

I have often thought how the illustration at Isaiah 655 applied to me in a figurative way. That prophecy talks about the time to come when the lion's violent disposition would be changed to a peaceful one to the point that he would eat straw like the bull. I felt that in a similar way, I had changed from being a very violent person to one having a peaceful disposition and a peaceful outlook on life.

Still, I had a bad reputation to live down. As an example, I regularly called on people from door to door to discuss the Bible with them. At one door, the young man who answered recognized me and became terrified, thinking I was there to do him harm. I quickly explained my message of peace from the Bible, leaving him dumbfounded but very relieved.

Not long after my baptism, I married one of Jehovah's Witnesses. Sad to say, in 174 my wife decided that she no longer wanted to do God's will. She gave me an ultimatum give up my way of worship or she would leave me, taking our two small children. That was the most difficult time of my life. But I could not abandon my worship of God, and I continued to do his will.

A New Way of Life

Yet, Jehovah rewarded me for continuing to be faithful to him. In 177, I met a wonderful Witness, and we got married. She had a five-year-old son. Soon my wife and I entered the full-time ministry, devoting ourselves to teaching others about God and his purposes. When our son grew up, he entered the full-time ministry also. He now assists with various duties in the local congregation.

My wife and I have since had the privilege of traveling to many parts of the world, doing volunteer construction work. This involves helping to build new branch facilities in various countries to support the worldwide educational work of Jehovah's Witnesses.

When we are home, we stay busy locally, helping others to learn about the Bible and in helping build new Kingdom Halls. I also serve on a Regional Building Committee in the southern part of the United States. And my former jail matemy sister's husbandand I serve as elders in the same congregation of Jehovah's Witnesses.

I am grateful to Jehovah for helping me to take control of my life and for giving it an entirely new direction. As I allow him to show me what is right and what is wrong, my life just gets better and better.Contributed.

An unanswered problem buried deep in the hearts of most woman, a problem lay buried and unspoken for many years. Fulfillment as a woman had only one definition for American women after 14; "the housewife/mother". This same "fulfillment" was the greatest dissatisfaction and of course unfulfillment that woman suffered in the middle of the 0th century in the United States. A question of definition. Who they were and what their purpose in life was. Women all across America silently asked themselves, "Is this all?"

Experts coached woman on how to catch a man and keep him, how to breastfeed, how to control sibling rivalry and how to buy a dishwasher. Not how to have a career or higher education because that would be "unfeminine". Older women were giving up their dreams, dreams that less than a century ago the now old-fashioned feminists fought for. Younger women weren't even thinking about dreams. The thought of being the "ultimate" housewife and mother consumed their minds. But this feminine way of thinking and feeling left most American women unfulfilled. Leaving them with countless questions all asking "why?" Not really knowing

who they were as people. They became mechanical robots of society, dulling their minds with every dishpan washed and feeling emptier with every bed that they made. One mother of four who left college to get married and have a family at 1 states;

"I've tried everything women are supposed to do-hobbies, gardening, pickling, canning, being very social with my neighbors, joining committees, running PTA teas. I can do it all, and I like it, but it doesn't leave you anything to think about-any feeling of who you are. I never had any career ambitions. All I wanted was to get married and have four children. I love the kids and Bob and my home. There's no problem you can even put a name to. But I'm desperate. I begin to feel I have no personality. I'm a server of food and putter-on of pants and a bed maker, somebody who can be called on when you want something. But who am I?"

This is just one case out of millions. Millions of women who lived day to day numb to their true selves and personality free. This supposed definition of fulfillment for them, the housewife/mother, literally was sucking the life out of our once strong-willed women.

In the late 10's and 10's the creation of the

"spirited career girl" was wide spread throughout magazines and media. The flapper was thought of as the wild, free spirited icon of women. However this creation was solely made from the minds of women. After the men returned from the war, women started to drop out of the field of writing and editing, leaving them with very little voice in the media circuit. Consumed and relieved that their men had returned home to them, they stopped their career of writing and started up a new one, as a wife. The writers who now began to take over were men, men home from war. These men, who over seas, dreamt of their wives waiting for them surrounded by their cozy and peaceful domestic life. And this became the new image of women, to however possible fulfill there mans dream of that perfect home life.

The family became the ultimate symbol of security for Americans tired of depression and war. Americans commitment to family and their ideal home life was accompanied by a belief that the men should be the wage earners for their families and the women should tend to the home and children. Women started to feel the heavy pressure bearing down on them. Pressure to make homemaking a career. Agnes Meyer sums it up when she wrote in the Atlantic Monthly in 150, "What modern woman has recapture is the wisdom that just being a woman is her central task and greatest honor. Women must boldly announce that no job is more exacting, more necessary, or more rewarding than that of housewife and mother." Women seemed to be brainwashed of all the struggles they endured and advances they had made in the last century.

A "housewife formula" arose. Fueled by the minds of man and carried out by the passive woman. Fancy articles whose topics usually consisted of new developments in psychiatry, medicine and sex and marriage still existed, however they were now spelled out in terms the average housewife could relate to and use in her everyday life. These articles turned into a detailed Do's and Don'ts list. Ranging from "How To Keep Your Husband Happy" to "How To Solve Your Childs Bedwetting." What was happening to the minds of our once ambitious women? A survey taken of women college graduates in the late 60's only proved the tunnel vision women had developed. When asked how they defined success, the most frequent answers women gave were "to be the mother of several accomplished children, and to be the wife of a prominent man."(Gaitlin, 17)

The stress put on women to become this ideal wife only led to a much more serious issue. Ironically the husband's place of rest was the wife's place of labor. An issue that coined the nickname "the problem that has no name". So many American women suffered this nameless, aching dissatisfaction for many, many years. Betty Friedman, notable author of the Feminine Mystique, wasn't even conscious of the woman problem. "Locked as we all were then in that mystique, which kept us passive and apart, and kept us from seeing our real problems and possibilities, I like other women, thought there was something wrong with me because I didn't have an orgasm waxing the kitchen floor," she states in her book.

This horrible boredom with life let to many problems, physical and emotional. Women were constantly driving their children to Little League, Boy scouts, dance lessons, grocery shopping, doing the laundry, just as she starts dinner the phone rings, it is an endless list of chores. This terrible tiredness led many women to the doctor in the 150's. Known as "housewife fatigue", these women in reality slept too much, as much as 10 hours a day. The real underlying problem was boredom. You try to sleep as much as you can to make the day go by faster. Some women were even being prescribed tranquilizers. Suburban housewives were popping them like candy. One-mother states in the Feminine Mystique, "You wake up in the morning, and you feel as if there's no point in going on another day like this. So you take a tranquilizer because it makes you not care so much that it's pointless." A survey done in 171 of four thousand women found that housewives, who accounted for 5 percent of the population, comprised 6 percent if the habitual diet pill users. Housework had become a main cause of women's depression and substance abuse. But in spite of all this turmoil and anxiety mothering was the most satisfying job they did.

Another illness was rapidly beginning to be reported. Many housewives were suffering from blisters and sores on their hands and arms. Women to somehow relive their stress or somehow escape from things for even a minute would for hours wash dishes. This constant exposure made their skin on their hands and arms blistery and raw. A cream could cure the physical sores, but there was no prescription for the sores that these women were suffering emotional. AS more and more women spoke out and to each other, they came to realize that they weren't as alone as they had thought. Other women, housewives and mothers, were feeling the same unsettling feelings they were.

The trouble with women through all these years hasn't been on that can be treated with a doctors visit or a prescription. It is a problem of identity. Betty Friedan states in the Feminine Mystique, "The truth is…it was true in my generation and it is true of girls growing up today-an American woman no longer has a private image to tell her who she is, or can be, or wants to be. Public images in magazines and television commercials sell us rejuvenating cleansers, hair dye and age defying face creams. Companies spend millions and millions of dollars for television time and ad space in newspapers and magazines because of one reason alone, "American woman no longer know who they are". Women need an image to look upon to find their true identity. This was true throughout the 100's and it is true now. American women are so unsure of who they are and who they want to be that they look up to these images and decide every detail of their life. The "problem that has no name", was truly a problem of identity.

Discuss how the use of film codes combined with the use of narrative techniques promoted and conveyed the main idea(s)/theme(s) in the film The Matrix

The film The Matrix using extraordinary film and narrative techniques presented many themes and ideas to the audience, however the foremost of these was that human created technology, if advanced too far, could interfere with what we comprehend as real and in some ways could remove features that make us human. The reason this theme was foremost is because the rapid advancing of technology today makes advanced machinery such as AI plausible. The themes in the film were accompanied by various biblical as well as eastern cultural references. Many themes and ideas put forward to the audience were presented through the use of various film techniques such as camera and audio. The combined narrative techniques along with the film techniques used in the film accentuate the themes that the producer intended to convey to the audience. The filming techniques that were used were based on very advanced technology and therefore invoked different responses from the audience.

The film The Matrix put forward themes that were intricately linked with one another, and the proximity of the situations the scenes that conveyed the themes were to our lives today forces the audience to think deeply about what was presented on the screen. The foremost idea that was presented questioned the meaning of reality, and how technology tampers with our definition of what is real and what isn't. This idea comes very close to us today; as Morpheus questions reality "What is real? If you define real to be what can be seen or touched or heard, then real is simply electric messages interpreted by our brains," it forces the audience themselves to then answer the question, of what real is, and whether what we actually see or hear is real. With reference to the matrix, Morpheus makes it apparent that this is what the matrix is doing; sending artificial messages to our brains making our minds think, even if it is not true. Scenes similar to this one displayed the intended messages and ideas, which caused the audience to have to think intensely about what has been presented to them on the screen. The foremost theme that was presented throughout the film was the idea that was most rapidly demonstrated and could be closely related to the audience.

The narrative technique of characterization was very important in promoting the theme in The Matrix. Especially significant was the characterization of Neo, being also Mr. Anderson, before he was introduced to the matrix; he was an ordinary businessman, working for a "respectable software company". The audience is able to readily relate to this character. This encourages the theme as it reveals that anyone can be taught the truth of the matrix. However, Neo was also living a routine based life without room for change; when Neo is asked to unplug and go to the party he is ready to say no, to continue his robotic style of life, making him more machine than human. This implies that everyone who does not wish to know the truth of the matrix is bound to the matrix, almost enslaved to it. The other freedom fighters were also at one stage living a routine life, supporting the point that anyone can be taught the truth. The characterization technique in The Matrix was used to support the theme, and does so appropriately so that the audience can easily relate to the main character.

In The Matrix, the camera was perhaps the most important and symbolic film code that was used for many reasons. Symbolically, a variety of camera shots were used to produce different messages to the audience. The lower angle camera shot was used often when an agent was on the scene, giving the impression of superiority over anybody else in the scene. When action takes place the camera used pan movements to follow the action, giving a wider view of the background, and this helped illustrate the point of the scene. Near the opening of the film, the character Trinity was running from pursuing agents over a rooftop hundreds of metres high. Panning right as she moved right, the audience can see that she is covering a very large distance, and as she reaches the edge of a roof, the camera view changes to a high camera angle looking down onto the road. This combination exemplified the setting of this scene, as well as giving the image that Trinity and the agents are superior from ordinary people, as the camera also panned slower when focusing on the policemen. From the wide range of camera shots that were used in The Matrix, the audience sees many symbolic scenes that can be interpreted to receive the ideas, which were intended to be conveyed.

Another form of camera use was visual techniques that provided stunning elements in some scenes, all of which seemed unreal and out-of-this-world. The use of these techniques promoted the question of realism in today's world, when we see unexpected occurrences in some of the scenes. The slowing and even stopping of time was used in several instances, which begged the question of whether time actually exists, however it also presented the idea that the characters within affected scenes were too fast to be seen in normal time. When the attack helicopter smashes into the glass building, this is done in slow motion, and before the actual breaking of the glass a shockwave reverberates across the building. In real life, a helicopter smashing into a wall of glass would not produce a visible shockwave and so this scene looks unreal, that this would not happen in real life. Because of this the scene also asks the audience the question of what can be taken as real or false. The use of visual techniques created with the aid of modern computer graphic technology not only looked awesome, it also interrogates the audience into what they observe as real.

Typically not used often in films, the written film code is used quite symbolically throughout the film but mostly at the beginning. Eerie green characters, not only from English but also from eastern languages, were used when displaying the matrix, in a font that looks systematic, giving the impression that the matrix is just a code language. Although this code does not seem like it would mean much, even the Warner Brother's symbol is coloured the same way, in a way expresses that everything is under the influence of the matrix.

Usually a large part of conveying the theme in films, the audio codes in The Matrix not only set the atmosphere of scenes, but they also emphasise what is happening in regard to the storyline. In this film however, music was undermined by the use of awe-inspiring visual techniques, though they were still present. The music that was used was often eerie or sounded very mechanical; as if it were computer generated. This is important as the matrix was said to be computer generated. Background sounds such as people talking on the street sets the scene and also makes it more realistic. Thunder was used whilst Morpheus was explaining to Neo the matrix, emphasizing the importance of this scene in conveying the story. Audio codes in The Matrix helped promote the storyline and set the scene but rarely supported or presented the themes to the audience.

The Matrix used some of the most advanced filming techniques seen to the date of release. These techniques supported the many themes presented throughout the film, especially the primary theme, which was that human created technology, if advanced too far, could interfere with what we comprehend as real and in some ways could remove features that make us human. Using new technology to generate awesome scenes and unreal visuals, the audience would respond to this film differently, as they would never have seen these types of scenes before. Undoubtedly, the camera use in the film was the most prominent, and these supported the theme the most, as the audience would be drawn mostly to the visuals in the movie. However, the narrative technique of characterization was very significant in conveying the theme in the audience, to do so would require the characters to be easily recognized and the audience would be able to effortlessly relate towards them. A variety of camera shots and techniques allowed the viewer to receive the messages from each scene. Overall, the linked combination between the film codes of audio, visual and camera along with the key narrative technique of characterization provided a firm, unblemished expression of the theme to the audience throughout the duration of the film.

Executive Summary

Nike is the largest athletic shoe and apparel company in the world with a market share of nearly forty percent. The company incorporated in 168, and has been headed by Phillip Knight, a co-founder and CEO, since its inception. Nike owns and operates over 700 factories worldwide and its products are distributed in 140 different countries.

Through extensive research amongst the consultants here at Prime Seven, we feel that our calculations prove that Nike's current share price is overvalued. In addition to this, we have also found that Nike has faced a decline in growth in revenue and net income, a decline in market share, a series of questionable labor practices, and a slumping United States Economy. For these reasons, we feel that the NorthPoint should not invest in Nike for its Large-Cap Fund.

Nike's Decline

Despite past years of great success, Nike has recently fallen into a slump. With the rise in competition from shoemaker Adidas and resurgence from Reebok, Nike's market share in the athletic shoe and apparel industry has dropped off dramatically in 000; down nearly ten percent. Nike also experienced an enormous drop in its revenue growth, which may signal to shareholders that it has already plateaued as a corporation. Nike peaked in 17 with a forty percent increase in revenue, but has only topped out at a five and a half percent increase ever since. The decline in revenue can directly be attributed to their decrease in net income, which has only grown at just below two percent for the first six months of 001.

On 0/6/001, after the close of the market, Nike issued a press release revising its third quarter and fiscal 000 earnings because of problems arising from the impact of implementing new demand and supply planning systems developed by i Technologies. Nike has been working on its i software implementation since June 000 as part of a $400 million IT overhaul designed to streamline communications with buyers and suppliers and lower operating costs. However, glitches with the i demand and supply planning module led Nike to overestimate demand for some shoes while underestimating demand for others.

The resulting inventory shortages will reduce Nikes fiscal third-quarter sales by as much as $100 million. Earnings estimates for the quarter have been cut to 4 to 8 cents per share from 50 to 55 cents. Analysts at Dain Rauscher Corp. lowered their estimate on Nikes 001 earnings to $.0 per share from $.5 per share following the February 001 disclosure of the software problem. Its 00 estimates were lowered to $.51 from $.70.

001 has also seen Nike's stock price plummet. As the company's earnings fall, so goes the stock price. As of July 1, Nike's share price has fallen twenty three percent since the beginning of the year. It is currently trading at $4.0 a share but has dropped as low as $5.50. When compared with the S&P 500 (down 10.7%) and the Dow Jones Industrial (down 4.7%) Nike is not coming close to beating or even matching the indices.

Ethical Considerations.

Since 15, Nike has faced heavy scrutiny from the public and the media for its work conditions of foreign laborers. Nike operates around 700 factories worldwide with the majority of its manufacturing taking place in third world or underdeveloped countries where the labor is extremely cheap by United States standards. Workers in these countries, which in some cases include children under the age of 14, work twelve to fifteen hours per day at very low wages. In Nike's Vietnam factories, laborers are only paid on average seventeen cents per hour and receive only one bathroom break per day. Phil Knight, CEO of Nike, withdrew a thirty million dollar pledge to the University of Oregon (his alma mater) in response to a protest by students against sweatshops and unfair labor practices.

Nike has also faced ethical problems with its shareholders. In March of 001, a class action suit was filed by Nike shareholders in response to Nike executives violating federal securities laws by reporting false and misleading financial statements for its third quarter. The false reports were directly tied to the supply chain problems Nike experienced with its faulty i software.

Current State of United States Economy

Another factor shareholders should consider a reason not to invest in Nike is the current state of the United States Economy. After the most virtuous period of investing in the history of the financial markets, the S&P, Dow Jones, and NASDAQ have all declined for the past three quarters. This is a definite sign of a decline in consumer spending and business investing, and may even indicate the beginning of a recession.

Nike's performance this year may also offset the portfolio of the NorthPoint Large Cap Fund. The mutual fund managers at NorthPoint only look to invest in large and established Fortune 500 companies for their large cap fund, in which Nike most certainly qualifies. However, other companies that NorthPoint has invested in for its fund which include ExxonMobil, General Motors, M, and McDonalds, have by far outperformed Nike in the financial markets in 001 and are keeping the fund afloat while the rest of the economy continues to slide.

Cost of Capital

When determining the true value of a stock, one of the most important figures we must analyze is the firm's weighted average cost of capital, or WACC. The WACC is important not only because it measures the component costs of debt and equity, but also because it is used as the discount rate in stock valuation. If the actual price of the stock is higher than the calculated price, then the stock is overvalued. If the stock price is lower, then the stock is undervalued. In theory, the calculated price and the actual market price should be equal. Otherwise, there is an imbalance in the market.

WACC is calculated as follows cost of debt, Kd, is calculated by dividing interest expense by the firm's average debt balance. In this case, the cost of debt is 4.%. Next, cost of equity, Ke, is calculated using the Capital Asset Pricing Model, or CAPM. This method is considered the superior method of calculating cost of equity by most textbooks, and 7% of the S&P 500 CFOs agree according to a 1 survey. After these two calculations are done, they are weighted according to their percentage of the total value of the firm. In Nike's case, equity is 7% of the total capital while debt is 7%. Finally, we simply plug these numbers into the WACC formula WACC = WdKd(1-T)WeKe. This calculation yields a WACC of 10.1%, which is essentially equal to the estimated cost of capital in Exhibit .

Exhibit is very important because it shows what Nike's stock price should be. Calculating the value of the shares has three main steps. First, all future free cash flows are calculated. Then, these cash flows are discounted using WACC as the discount rate. It is important to note that the WACC must be used as the discount rate. Otherwise this calculation will result in incorrect data. Finally, debt is subtracted from the total value of the firm, and the remainder is divided by the total number of shares. The resulting stock price is approximately $6.14. Now that we know what Nike's stock price should be, we compare it to the current price of $4.0 and discover that the stock is overvalued. This is an indication that the price is going to go down in the future, especially since the economy is showing signs of a decline and possible recession. Evidence of a decline is also demonstrated by Nike's deteriorating profitability ratios. Almost all of the ratios, shown in the attached PowerPoint slides, have declined since 17, providing further evidence that Nike is not a good investment at this time.

Conclusion

Given our extensive quantitative analysis, Nike's declining growth in both revenue and net income, the current downward trend of the economy, and the ethical scrutiny that the company is facing, we feel that it would not be wise for NorthPoint to invest in Nike. Despite Nike's reputation for success, competitors such as Adidas, Reebok, and New Balance are slowly chipping away at Nike's market share. Although Nike has historically had a high stock price, the problems they are facing such as their multi-million dollar restructuring and supply chain miscalculations has caused their stock price to decline. Also, according to our quantitative analysis, Nike's weighted average cost of capital indicates that the stock is overvalued and, with the declining economy, the share price will fall to its equilibrium price and possibly even lower.
